Terms of Service

These Terms of Service govern your use of the Lingophant app and website (together, “the Service”). The Service is operated by Lingophant e.U., a sole proprietorship registered since 2016 in Austria (Firmenbuch 460813t, Handelsgericht Wien). By using the Service you agree to these Terms.

1. What Lingophant is

Lingophant is a language-learning app. It helps you build and practice vocabulary using your own phrases, example sentences, and listening practice. It works for 30+ languages.

2. Your account

You can use some features without an account. When you create one, you’re responsible for keeping your login credentials secure — you’re not allowed to share access with others.

If you sign in with Apple, Google or Facebook, their terms also apply to that authentication step.

We don’t save a copy of your password and use state-of-the-art technology to protect your data.

3. Your content

Phrases and sentences you add to the app are yours, Lingophant cannot see or access their contents. Only by uploading them do you give us a limited license to store and process them solely to provide the sharing service to you. We don’t use your content to train AI models, share it with third parties for their own purposes, or sell it.

When you delete your account, your phrases and profile data are deleted from our servers immediately. Financial transaction records (e.g. subscription receipts) are retained for 7 years as required by Austrian accounting law — see our Privacy Policy for details.

4. Premium subscription

What’s included. The free version of Lingophant gives you access to core features. A Premium subscription removes usage limits and unlocks additional features. What’s included is shown in the app and may evolve over time.

Price. The subscription price is shown in the App Store (iOS) or Google Play (Android) when you subscribe. Prices may vary by country and currency. We may adjust pricing in the future — if we do, we’ll give you advance notice before your next renewal date.

Free trial. If a free trial is available at the time you subscribe, the trial duration and terms are shown in the store before you confirm. At the end of the trial, your subscription converts to paid automatically unless you cancel before the trial ends. You won’t be charged during the trial.

Auto-renewal. Your subscription renews automatically at the end of each billing period at the then-current price. You can turn off auto-renewal at any time — cancellation takes effect at the end of the current paid period and you keep Premium access until then.

How to cancel. Cancel through your App Store or Google Play account settings. We don’t control billing and can’t cancel subscriptions on your behalf. If you’re unsure how, email us and we’ll point you in the right direction.

Refunds. Purchases are processed by Apple or Google under their own refund policies. We can’t issue refunds directly for App Store or Play Store purchases. If you have a problem, contact Apple Support or Google Play Support first.

5. Your right to withdraw (EU and EEA customers)

If you’re based in the EU or EEA, you have the right to withdraw from a new subscription contract within 14 days of the date of purchase, without giving a reason.

How to use it. Refunds are handled by Apple / Google. For iOS users please go to apple.com/bill. Android users please do it with Google directly. In case of other issues or if you need assistance you can mail us under team@lingophant.com. We will coordinate an applicable refund if it’s possible from our side.

If you use the service immediately. If you start using Premium features straight away (which happens by default when you subscribe), you’re expressly requesting that we begin performing the service before the withdrawal period ends. If you later withdraw, we’re entitled to charge a pro-rata amount for the days the service was available to you. If the full billing period has elapsed within the 14 days, the right of withdrawal no longer applies to that period.

This section doesn’t affect any statutory rights you may have under your local consumer law that are more favourable than the above.

6. Acceptable use

You agree not to:

  • Upload or share content that is illegal, harmful, threatening or offensive
  • Attempt to access another user’s account or data
  • Reverse-engineer, decompile or copy any part of the app
  • Use automated tools to extract or scrape content from the Service
  • Use the Service in a way that could damage or overburden our systems

We may suspend or terminate accounts that seriously or repeatedly breach these rules. For minor issues we’ll try to give you a heads-up first.

7. Our intellectual property

The Lingophant app, its design, branding and underlying technology are owned by Lingophant e.U. and protected by copyright and other intellectual property law. These Terms give you a personal, non-transferable licence to use the app for your own language learning — nothing more is transferred to you.

8. Availability and changes to the Service

We work hard to keep Lingophant running reliably, but we can’t guarantee uninterrupted or error-free access. We may update, modify or remove features at any time. For significant changes that affect you materially, we’ll aim to give you reasonable notice in the app or by email.

9. Limitation of liability

To the extent permitted by Austrian law:

  • We’re not liable for indirect or consequential losses (including lost data, lost profits or lost opportunities) arising from your use of or inability to use the Service.
  • Our total liability for any claim arising under these Terms is limited to the total amount you paid us in the 12 months immediately before the claim.

Nothing in these Terms limits our liability for gross negligence, intentional misconduct, personal injury, death, or any other liability that cannot lawfully be excluded under Austrian consumer protection law (KSchG).

10. Changes to these Terms

If we make material changes to these Terms, we’ll notify you in the app or by email at least 30 days before the changes take effect. Continuing to use the Service after that date means you accept the updated Terms. If you don’t agree with the changes, you can cancel your subscription before they come into effect and stop using the Service.

11. Governing law and dispute resolution

These Terms are governed by Austrian law. If you’re an EU consumer, you also benefit from any mandatory consumer protection provisions of the law of your country of residence that provide greater protection.

EU Online Dispute Resolution. The European Commission provides an online dispute resolution platform for consumers at http://ec.europa.eu/odr. You can use this platform to submit a dispute if you’re unable to resolve it with us directly. Our email address for ODR purposes is team@lingophant.com.
